Photography Services Agreement

1. Services Provided

1.1. The Photographer agrees to provide photography services as described in the agreed-upon package or services.

1.2. The Client agrees to cooperate and provide necessary information to enable the Photographer to fulfill the agreed-upon services.

2. Payment

2.1. A non-refundable retainer fee of [20%] is due upon booking to secure the Photographer's services.

2.2. The remaining balance is due [2 weeks] before the scheduled date of the photography session.

2.3. Additional charges may apply for extra services or products not included in the original agreement.

3. Cancellation and Rescheduling

3.1. The Client may cancel or reschedule the session by providing written notice to the Photographer.

3.2. If the Client cancels within [1 week] of the scheduled session, the full fee will be retained by the Photographer.

3.3. The Photographer reserves the right to reschedule due to unforeseen circumstances, such as inclement weather or equipment failure.

4. Copyright and Usage

4.1. The Photographer retains copyright and ownership of all images.

4.2. The Client is granted personal use rights to the images for non-commercial purposes.

4.3. The Client agrees not to edit, alter, or use the images for commercial purposes without the Photographer's written consent.

5. Model Release

5.1. The Client grants the Photographer the right to use the images for promotional purposes, including but not limited to social media, website, and portfolio.

5.2. If the Client does not wish to have their images used for promotional purposes, they must notify the Photographer in writing before the session.

6. Delivery of Images

6.1. The Photographer will provide edited, high-resolution images within [2 weeks] of the session. For wedding sessions images will be provided within 6-8 weeks from the date of the session.

6.2. The delivery timeline may be affected by unforeseen circumstances, and the Photographer will communicate any delays to the Client.

7. Liability

7.1. The Photographer is not liable for any injuries, damages, or losses incurred during the photography session.

7.2. The Client is responsible for the behavior of individuals at the session, and any damage caused to equipment or property.

8. Client Cooperation

8.1. The Client agrees to cooperate and follow the Photographer's directions to ensure the best possible results.

8.2. The Photographer is not responsible for dissatisfaction due to the lack of cooperation or unforeseen events beyond their control.

9. Governing Law

9.1. This agreement shall be governed by and construed in accordance with the laws of [South Carolina].

Terms of Sale

Terms of Sale for [MP Image and Video, LLC]

1. Acceptance of Terms By accessing and using [MP Image and Video, LLC] website (“www.marctooktheshot.com") and purchasing any products or services, you agree to comply with and be bound by these Terms of Sale.

2. Orders and Payments 2.1 All orders are subject to acceptance and availability. 2.2 Prices are listed in [US currency] and include applicable taxes unless otherwise stated. 2.3 Payment must be made in full at the time of order placement.

3. Delivery 3.1 Digital Products: Upon successful payment, digital products (e.g., digital downloads, online courses) will be delivered electronically to the email address provided. 3.2 Physical Products: The delivery time for physical products (e.g., prints, albums) will be communicated during the ordering process. Additional shipping charges may apply.

4. Refund and Cancellation Policy 4.1 Digital Products: Due to the nature of digital products, all sales are final, and no refunds will be provided. 4.2 Physical Products: Refund requests for physical products must be submitted within [5] days of receiving the product. Items must be returned in their original condition and return shipping costs are the responsibility of the customer.
